Paying for purchases with a bank card has become a common thing for many people, but there are situations when it becomes necessary to return the purchased goods. The procedure is regulated by the legislation of the Russian Federation.

Buyer return procedure

If the buyer was disappointed with the quality of the product or he simply did not fit, then the seller needs to follow these steps to return the purchase:
  1. come with the product and the receipt to the store where the purchase was made
  2. inform the seller about the intention to issue a return
  3. inform the reason
  4. hand over the product and the check to the seller
  5. make sure that the seller draws up an act of return
  6. fill out an application according to the form suggested by the seller

Required documents

In addition to the purchased product, you must also bring the following documents to the seller or the specialist responsible for the return:
  • passport
  • sales receipt and a receipt from the trading terminal on withdrawing funds from a payment instrument
  • bank card

Conditions

According to the law, every buyer who is disappointed with the purchased item has the right to return the goods within 14 days from the date of purchase, and then get their money back.

When buying clothes, household appliances and other valuable items, you should check their quality. If something does not suit you, you must immediately contact the store for a return. In this case, the product can be returned under the following conditions:
  • the product has retained the properties and appearance that it had at the time of purchase
  • there is no mechanical damage on the product due to the fault of the buyer
  • preserved packaging and receipt

It is very important to check the product for defects before paying, since it is rather difficult to prove that it was damaged prior to the purchase.

If you check the goods in a timely manner and contact the store on the day of purchase, then the money will be returned to the buyer's card much earlier than when contacting within fourteen days.

If you apply the next day after purchase or later, the procedure can take a long time.

Important
To return, you need to keep the receipt and packaging. If the goods were paid by a bank card, then you need to have two checks (from the cash register and from the bank terminal for withdrawing funds).

Only the owner of this card can return a product that was paid for with a bank payment instrument. There are situations when the cardholder's close relatives pay for purchases with a card. If in such a situation there is a need to return, then only the owner should go to the point of sale.

Terms of refund

When paying for a purchase in cash, the refund procedure is greatly simplified, since the cashier simply gives the money to the buyer from the cash register. If the purchase is paid for by card, then the procedure becomes much more complicated. The term in which the money is returned to the card depends on the efficiency of the work of all participants in the process (employees of the bank and the accounting department of the outlet). The term is from 3 to 40 days.

In most cases, money is credited to the account within 10 - 12 days. Legislation limits the period for refunding funds to the buyer's card to one month, but sometimes delays occur.

The buyer has the opportunity to track the progress of the processing of his application. To do this, you need to contact the store's accounting department or the bank's consultants.

There is one exception to this rule. If you return the goods paid for in the store by credit card on the day of purchase, the return procedure will be simplified. In such a situation, the transfer of funds from the card to the merchant's account will simply be canceled, and the money will be returned to the account almost instantly.

Is it possible to get a refund in cash from the checkout

The seller can return funds from the cash register in cash only if the purchase was paid for in cash. When paying with a bank card, a refund from the cash register is not possible, since such a procedure contradicts the requirements of the law. The seller simply will not be able to return the money on such conditions, since if the tax service detects such actions, the store will be fined.

The procedure between the store and the bank

It is worth understanding in more detail what happens after you apply for a refund. The procedure consists of the following operations:
  1. The accounting officer of the store must transfer to the bank, which accepts payments from customers when paying by card, customer applications for a refund. This procedure takes from one to several days. Terms depend on the efficiency of the accountant's work
  2. the application is processed by bank employees. The fact of payment is being verified. This can take no more than three days.
  3. after processing the application, funds are transferred to the general bank account in which the buyer's card is issued
  4. at the final stage of the refund, the money is transferred to the client's card account. The terms depend on the efficiency of the bank in which the card is issued.
Often, delays in refunds are not related to the efficiency of the outlet staff. However, there are situations when buyers incur certain losses due to late refunds. In such a situation, the buyer has the right to demand compensation from the seller for the losses incurred. It is possible to claim compensation for losses only in a situation where the deadlines established by law are violated.

If the refund is delayed, then buyers are advised to enter into negotiations with the bank and store employees to resolve the situation. When customers contact, as a rule, all transactions begin to occur faster.

Legislative regulation

The procedure is regulated by the Law of the Russian Federation "On Protection of Consumer Rights". Also, the regulations for transferring funds to a client's card are influenced by the requirements of the Tax Code of the Russian Federation, which makes it impossible to return funds in cash when paying for a purchase with a bank card.

If, when returning the goods, certain disputes or conflict situations arise with the store employees, then the buyer should carefully study the documents to prove his innocence. It is important to refer to legislation.

What to do if you lost your check

There are situations when it becomes necessary to return the goods, but the receipt received at the point of sale at the time of purchase is lost. In such a situation, a refund to the bank card is possible if the buyer manages to find witnesses who can confirm the fact of the purchase. Stores are reluctant to return funds in the absence of a check, but the legislation gives the buyer the opportunity to confirm the fact of the purchase with the testimony of witnesses. If employees do not agree to return the money, then you can go to court, where the testimony of witnesses will be taken into account as strong evidence.
