Why should I know about this?
In Russia, criminal cases are often initiated for the most bizarre reasons, for example, for catching Pokemon in the temple — so just in case, it's better to be prepared for anything. But now I decided to tell you about the house arrest.

Is house arrest a punishment?
Not quite. This is a type of preventive measure — that is, a measure that is applied to people awaiting trial in their case. After a person is accused of something, the court first decides what to do with the suspect while the investigation is underway. House arrest in Russia appeared recently-at the end of 2009 (it has been applied since 2010).

Under house arrest are often defendants in high-profile cases: opposition politician Alexey Navalny, director of the Library of Ukrainian Literature Natalia Sharina, video blogger Ruslan Sokolovsky and many others. In other cases - with similar charges, but not so resonant-people are more often sent to the pre-trial detention center. Sometimes the investigation offers prisoners a transfer from the detention center to house arrest in exchange for confessions and cooperation with the investigation.

A judge can order house arrest instead of being held in a pre-trial detention center if there are extenuating circumstances: for example, a small child, some serious illness, or no criminal record. Still, house arrest is quite a rare measure of restraint. In the first half of 2016, the courts appointed her 2405 times. For comparison, during the same period, 63,556 people were sent to the pre-trial detention center.

How does house arrest work? A person is simply not allowed to leave the apartment?

No, it's a bit more complicated than that. Law allows the court to create different conditions of house arrest. Most often, it is made as strict as possible: it is forbidden to go out, communicate with certain people, send and receive letters, use the phone and the Internet. This is the tradition of Russian courts — it is easier for investigators and judges to rewrite all the restrictions from the Code of Criminal Procedure, without particularly delving into the specifics. But in theory, you can apply for more lenient conditions — for example, ask the court to allow you to go to work or for walks. If you become seriously ill, you may be allowed to temporarily serve your house arrest in a hospital.

You can only sit in your own apartment?
You can also live in a rented apartment — the main thing is that you have a legitimate reason to live there. But these grounds must be supported by documents: for example, registration or a lease agreement for residential premises. Most often, a person is sent under house arrest to the place where he usually lives, but there are exceptions — for example, blogger Ruslan Sokolovsky, who is accused of catching Pokemon in the temple, lives in the apartment of his lawyer.

Will I have a warden with me?"
No. But they will put a special bracelet on your leg, which will allow you to monitor whether you are violating the conditions of arrest. The apartment will set up a point for receiving the signal, and if it is interrupted, the FSIN inspector will come or call to find out what happened. A broken wristband will not be able to transmit a signal. In addition, you may have wiretaps and surveillance cameras installed, but you must be warned about this in advance. No cameras are installed in the bedrooms, bathroom, or toilet. If you are suspected of violating the conditions of house arrest, the court may change the measure of restraint to a more stringent one — pre-trial detention.

What does a ban on communicating with certain people mean? Who is this about?
Usually — about other persons involved in the criminal case. But it happens that you are forbidden to communicate with everyone, except for relatives who live with you, and a lawyer. Everyone serving house arrest has the right to call the emergency services, an investigator, and an inspector of the Federal Penitentiary Service, regardless of restrictions.

Speaking of relatives. Will they also be banned from using the Internet and phone?
No, no restrictions apply to relatives. So they can make a phone call, write a letter, or even post on Facebook on your behalf. For example, during the arrest of Alexey Navalny, his social media pages were maintained by employees of the Anti-Corruption Foundation and his wife. But there is a danger here: the investigator and the court may decide that this is a violation of the conditions of arrest and send you to the detention center. So it is better if the person who conducts correspondence and social networks for you indicates every time that the text was written by him.

If I search the Internet, will it always be possible to say that it is one of my relatives?
You can say that, but it is dangerous to violate the terms of arrest. At any time, they can come to you with a search, take away all your computers, analyze your correspondence and browsing history, and try to accuse you of violating the conditions of house arrest. If I'm banned from going to work, will I get fired?
A lot depends on your relationship with your employer. But remember, the law does not allow you to be fired, because it is considered that house arrest is a valid reason not to go to work. You may be able to organize your work from home, but for many professions, the lack of a phone or Internet connection precludes this possibility.

What do I have to live on if I'm banned from working?
This is an important question — there may be difficulties with money. If you don't have any savings, maybe your friends or relatives will help you. If this is not possible, and you have absolutely nothing to live on, you should contact the investigator or the court and ask to change the conditions of house arrest or the measure of restraint to a more lenient one-to allow you to earn a living.

And who will go to the store?
This is usually done by relatives of the arrested person. Because the arrested person himself, as a rule, must obtain the permission of a judge or investigator for each trip to the store.

House arrest — is it for a long time?
It all depends on the circumstances of the criminal case and the nature of the charges. According to the law, the maximum term of house arrest is two months, but it can also be extended at the request of an investigator. Each time it is decided by the court, and you and your lawyer at the meeting can try to convince the judge that in your situation house arrest is too strict a measure of restraint.

If you are accused of committing a minor crime, then the maximum period of house arrest during the investigation period is no more than six months. For serious and especially serious crimes, long periods of detention under house arrest are provided (one and a half years, and in some cases even more).

Journalists asked the municipal deputy Konstantin Jankauskas, who spent a year under house arrest, to answer this question.:

When the court severely restricts communication, you can probably really go crazy."
