The legal community considers it necessary to develop law enforcement practice in the digital sphere. Now it is almost absent, although the number of victims of crimes, the subject and means of which are cryptocurrencies, is growing. A round table was devoted to this topic as part of a meeting of the Commission on Legal Support of the Digital Economy of the Moscow Branch of the Russian Lawyers Association.
One of the proposals voiced at the meeting was the creation of a "digital prosecutor's office" for cryptocurrency cases. Lawyers argue that the small number of criminal cases and sentences for fraud with cryptocurrencies is a consequence of the lack of specialized knowledge among law enforcement officers. Meanwhile, the number of victims of cryptocurrency crimes is only growing.
Lawyers find it difficult to assess criminal actions with new digital assets, and the police do not want to get involved with such cases at all, said the law office Asnis and Partners. Currently, there is almost no law enforcement practice in the digital sphere, since the law "On digital assets" has not yet been adopted.
To remedy the situation, it is necessary to clarify the terminology in the legislation and find specially trained people to work with cryptocurrency crimes, the lawyers decided. Special investigative units should specialize in the investigation of criminal cases in the field of digital projects. Such a department was tacitly dubbed the "digital prosecutor's office".
However, the Ministry of Internal Affairs does not agree with this interpretation. According to the representative of the department Artyom Ranchenkov, the small number of investigated cases is connected not with the lack of special education among law enforcement officers, but with the unwillingness of the victims to disclose to the investigation the source of the origin of the cryptocurrency ...
